Participants will learn from real life legal battles over ownership of the copyrights of art, with pictures of the art itself, facts and the legal lessons behind those clashes. Participants will also learn about the different types of authorship (sole, joint, work for hire) and a variety of legal implications within each category. Other topics include: what makes something “original” with examples of photography, graffiti, painting, poster design, and sculpture; derivative works and the difference between them and “copying” or infringement; the difference between copyrightable design and mere utility; how the public domain works, understanding fair use as a defense; basic tips on how to enterprise your work; and the life of a copyright.
This will be accomplished through a back and forth between the presenter and the audience (60%) analyzing case law and legal theory, a look at a modern real life case study of one artist using another’s work without permission in Chicago in 2017 (20%), and the sharing of informational resources (20%).
This event is not limited to the mediums of art listed. Legal principles have wide application; therefore, artists in all visual arts may benefit from this workshop.
